［摘   要］农业保险在我国财政支农体系中发挥着越来越重要的作用。然而，近年来农业保险市场上的虚假投保、虚假理赔等违法违规行为却一直存在，成为农业保险高质量发展中的顽疾。本文根据2012年以来各地法院的判决和保险监管机构行政处罚决定书所公开披露的信息和数据，从发展趋势、参与主体、产生事由、行为后果等角度分析了农业保险市场违法违规行为的特征，在此基础上从业务特性、运作规则、监管体系等方面探寻了违法违规行为产生的原因，最后提出从优化补贴方式、健全运作规则、加强监管等方面进行系统性治理。

Characteristics and Governance of Illegal and Irregular Acts in Agricultural Insurance Market:An Analysis based on Court Judgments and Regulatory Penalties

Abstract：Agricultural insurance plays a more and more important role in China′s fiscal support system for agriculture.However,in recent years,illegal and irregular acts such as fraudulent insurance and claims in the agricultural insurance market have been at a high incidence,which has become a chronic problem in the high-quality development of agricultural insurance in China.Based on the information and data publicly disclosed by China Judgements Online and the administrative penalty decisions of China Banking and Insurance Regulatory Commission since 2012,this paper analyzed the characteristics of such acts in the agricultural insurance market from the perspectives of development trend,participants,direct causes and consequences.On this basis,the paper explored the root causes of these acts from the aspects of business characteristics,operation rules,supervision system,etc.Finally,it suggested to strengthen systematic governance from the aspects of optimizing subsidization methods,perfecting operation rules,reinforcing supervision,etc.
